In this tutorial, we will show you how to specify your shipping costs and delivery times, as well as payment terms and warranty in your online store in a legally compliant manner. Here you can find out how to make your online store legally compliant with the help of the Händlerbund.
In addition to the legally compliant price display and the correct integration of your terms and conditions, your imprint and the cancellation policy, it is important to know that you have to indicate the shipping costs in the store and how this has to be done. The latter is what this article will be about. If you missed the videos on generating legal text, embedding, and pricing, here’s the link to the playlist. In this article, the first part will deal with the indication of shipping costs and delivery times, i.e. where and how these are to be indicated. The second part then deals with the terms of payment and warranty. The whole thing is demonstrated as before using our Shopify store.
So what do you have to consider regarding the shipping costs in your online store?
According to the Price Indication Ordinance, the shipping costs must be included in the total price. Therefore, the indication of shipping costs must be complete at a glance with the item price. This includes shipping discounts, as well as shipping exemptions when buying multiple items. For this purpose, the addition “plus shipping costs” with a link to the shipping conditions must be found in the price after the VAT note. It all sounds very theoretical, so let’s apply it practically in our Shopify store.
We have already shown you how to integrate the shipping conditions in a legally compliant manner and display them in the frontend in our second blog article. This is how it should look in your navigation. But beyond this payment and shipping page in the footer, must be provided as mandatory information the indication of the delivery time on the article. That’s why we’re going to go into our product overview and see how to incorporate it into Shopify. Unfortunately, there is not yet a button for specifying the delivery time, which is why we include it in the description. In order to really fulfill the obligation, enter this delivery time information in the first line of the product description.
In addition to the delivery times, it is also important to inform about the available means of payment. This information is mandatory as an online merchant. But if you use the legal text generator from the Händlerbund, which we presented in the first episode, then these mandatory details are already included in the document “Payment and shipping” . That means you don’t have to change anything manually anymore. Accordingly, we can now move on to the warranty, what to consider here?
If you want to offer a warranty for a product, you must then also communicate this transparently to the consumer. Both the existence of the warranty and the respective warranty conditions must therefore be integrated as full text in the respective item description. However, we will take a closer look at what needs to be taken into account and how the warranty conditions are to be specified in the information document from the dealer association. There is once a distinction between legal warranty and the warranty. The legally binding warranty is something legally defined and the guarantee is something voluntary.
This means that the statutory warranty is intended to guarantee the customer that the goods are free of defects. This means that it must be free of material defects and defects of title. This is laid down in the BGB. For the customer this means that he is legally assured that the goods would be repaired or delivered new if he makes use of the legal warranty. If this should arrive defective again with him, the possibility of the resignation/the payment of damages/ or the reduction exists for example. of the price.
A warranty, on the other hand, is a voluntary goodwill gesture on the part of the manufacturer, the purchaser or a third party. This does not refer to the condition of the product at the time of handover, as this is covered by the statutory warranty, but refers to the functionality of certain parts or the entire device over a certain period of time. This warranty can then be enforced against the party who granted the warranty. Therefore, it can also happen that you go to your trusted electronics retailer and want to make use of the 24-month warranty, but the employee then refers you to the manufacturer because they have granted the goodwill service.
In the further course of this leaflet it is pointed out once again that the existence of the guarantee obliges the online trader to inform about the existence of this guarantee as well as to explain the conditions of the guarantee, because in case of contravention there is a risk of warning. Mostly online retailers are warned about the existence of a warranty, but not about the conditions. And online retailers who do not even inform about the existing warranty. Both can be warned off. Therefore, we recommend that you read at least this section on the provision of information before and after the conclusion of the contract, as well as the section on warranty conditions. These should then be applied to each of your products, if they have a warranty.
